People usually look for a property lawyer in Raipur or Bilaspur at one of two moments: before a purchase, to check the title, or after a dispute has begun over boundaries, possession, shares or a failed sale. The right forum matters as much as the right claim, because some questions belong to the civil court and others to the revenue courts.
Title, possession and injunction suits
A suit for declaration and possession asks the civil court to confirm who owns a property and to restore it to the owner. Limitation matters: a suit for possession based on title must generally be filed within twelve years from when the defendant's possession became adverse.
While a suit is pending, the court can grant a temporary injunction under Order 39 of the Code of Civil Procedure, 1908 to stop construction, sale or dispossession. It looks for a prima facie case, the balance of convenience and the risk of irreparable harm. A permanent injunction may follow in the final decree.
Partition suits and co-owned property
Where co-owners or heirs cannot agree on dividing property, any of them can file a partition suit. The court first passes a preliminary decree declaring each party's share, and then a final decree dividing the property by metes and bounds, often with a commissioner's help. Where the property cannot be conveniently divided, it may be sold and the proceeds shared.
Since 2005, daughters are coparceners by birth in Hindu joint family property and must be joined as parties. The Tehsildar can also partition an agricultural holding among its co-owners where no question of title is raised. Our page on wills and succession covers inheritance before a dispute arises.
Sale agreements, title checks and specific performance
Before you buy, a title check should cover the chain of ownership, encumbrances and pending litigation, and the revenue records on the State's Bhuiyan portal. For agricultural land, it should also confirm whether the land has been diverted for non-agricultural use, and whether it belongs to a member of a Scheduled Tribe, since the Chhattisgarh Land Revenue Code, 1959 restricts transfers of such land to non-tribal buyers.
A sale of immovable property worth ₹100 or more must be made by a registered deed. If the seller backs out after an agreement to sell, you can sue for specific performance. Since the 2018 amendment to the Specific Relief Act, courts enforce such contracts as the rule rather than the exception, provided you show you were ready and willing to perform your part. The suit must generally be filed within three years.
Revenue courts, RERA and recovery
Mutation of names, demarcation of boundaries and correction of land records are decided by the revenue courts under the Chhattisgarh Land Revenue Code, 1959: the Tehsildar, the Sub-Divisional Officer and the Collector, with further appeals and revisions within the revenue hierarchy. Mutation serves revenue purposes and does not decide title, so a genuine ownership dispute still goes to the civil court.
Buyers of flats and plots in registered projects can complain to the Chhattisgarh Real Estate Regulatory Authority under the Real Estate (Regulation and Development) Act, 2016. If the promoter fails to give possession as agreed, you can withdraw and claim a refund with interest, or stay and claim interest for the delay. Structural defects reported within five years of possession must be rectified by the promoter. A complaint before the Consumer Commission is sometimes an alternative, as our consumer disputes page explains.
We also bring and defend suits for recovery of money under property transactions, arrears of rent, and compensation for wrongful occupation (mesne profits).
Property disputes in Raipur and Bilaspur
Civil suits are filed in the civil courts at the district court complexes in Raipur and Bilaspur, the court depending on the value of the claim. Revenue matters begin at the Tehsil office for the area where the land lies, and registered documents are executed before the Sub-Registrar. Second appeals from civil decrees, and writ petitions against revenue orders, are heard by the High Court at Bilaspur.

Questions about Property & Civil Disputes
What is a partition suit?
A partition suit asks the civil court to divide property held jointly by co-owners or heirs. The court first passes a preliminary decree declaring each party's share, and then a final decree dividing the property by metes and bounds, usually after a commissioner reports on how it can be divided. If the property cannot be divided conveniently, the court may order its sale and the division of the proceeds.
Can I stop construction on disputed land?
Yes, once you have filed a suit. The court can grant a temporary injunction under Order 39 of the Code of Civil Procedure to stop construction, sale or dispossession while the case is pending. You must show a prima facie case, that the balance of convenience favours you, and that you would suffer irreparable harm without the order. In urgent cases the court can pass an interim order before hearing the other side.
Does mutation prove ownership?
No. Mutation records a change in the revenue records, usually after a sale or a death, so that the right person pays land revenue. The Supreme Court has repeatedly held that revenue entries do not confer title. If ownership is genuinely disputed, the question has to be decided by the civil court, and the revenue records are then corrected to match its decree.
What can I do if the seller refuses to execute the sale deed?
You can file a suit for specific performance of the agreement to sell, generally within three years of the date fixed for the sale or, if no date was fixed, of the seller's refusal. Since the 2018 amendment to the Specific Relief Act, courts enforce such contracts as the rule, but you must show that you have been ready and willing to pay the balance and perform your part.
Where do I complain about delayed possession of a flat?
If the project is registered under the Real Estate (Regulation and Development) Act, 2016, you can complain to the Chhattisgarh Real Estate Regulatory Authority and seek a refund with interest, or interest for the period of delay. Buyers may also approach the Consumer Commission for deficiency in service. The choice depends on the relief you want, the project's registration and any proceedings already filed.
How is land demarcation done in Chhattisgarh?
Demarcation is sought by applying to the Tehsildar under the Chhattisgarh Land Revenue Code, 1959. Revenue staff measure the land against the settlement maps and records, with notice to the adjoining holders, and the Tehsildar passes an order fixing the boundary. A party dissatisfied with the order can appeal within the revenue hierarchy, and a dispute about title still has to be decided by the civil court.
What should I check before buying land in Raipur?
Check the chain of title, encumbrances and pending cases, the khasra and B-1 entries on the Bhuiyan portal, and whether the seller's name matches them. For agricultural land, check whether it has been diverted for non-agricultural use and whether any restriction on transfer applies, such as those protecting land of Scheduled Tribe members. For a flat or plot in a project, check its RERA registration.
